COS - Change of Status
By applying for a Change of Status (COS), you can continue to reside in the United States as you await the outcome, on the condition that your application is submitted promptly to the US Citizenship and Immigration Services (USCIS).
Undergoing a Change of Status (COS) is a rite of passage for many immigrants during their journey in the United States. For instance, transitioning from an F1 student to an H1B worker is a pivotal COS moment. Similarly, shifts from H4/F2 dependent visas to F1 student status, or from H1B work visa to H4 dependent visa, are part of this essential process.
H1B to F1
When getting laid off on H1B, one option is to apply for a change of status within the grace period to an F1 visa and continue your study and working journey in the US by using F1 - CPT.
H1B to B1/B2
In 2023, USCIS explained that while B1/B2 visa holders cannot work, foreigners can legally seek employment. You can switch from H1B to B1/B2 status if laid off, explore new job opportunities, and then arrange an H1B transfer with a new employer.
H4 to F1
H4 visas come with many restrictions, one of which is cannot work until the H1B holders start their Green Card process. Changing to F1 provides H4 holder not only the opportunity to get an US degree but use CPT to work and earn.
B1/B2 to F1
Are you contemplating enrolling in a U.S. institution while here on a travel visit? Rather than undertaking the journey back home, opting to adjust your status to an F1 student within the U.S. could significantly streamline the process for you.
