Updates on OPT Application, Process, and Common Pitfalls to Avoid

Optional Practical Training or OPT allows international students in the US to extend their stay and work after graduation. Eligible students can obtain up to 12 months of employment authorization or up to 24 months for those with a STEM degree. Understanding the OPT application process and eligibility requirements can improve your chances of approval. It's also essential to be aware of potential OPT application pitfalls that could lead to rejection or denial.

What are the steps to apply for OPT?

Per US Citizenship and Immigration Services (USCIS), the initial step for OPT application involves securing a recommendation from your school's Designated School Official (DSO). The DSO should endorse your "Certification of Eligibility for Nonimmigrant Student Status" or Form I-20 and make a corresponding note in the Student and Exchange Visitor Information System (SEVIS).

Subsequently, you need to file the "Application for Employment Authorization" or Form I-765 with USCIS. Be sure to pay the necessary fee and provide the required supporting documentation as outlined in the forms.

When should you apply for OPT?

For both STEM and non-STEM degree holders, the OPT application process should commence only after your DSO has recommended you in your SEVIS record. From that point, you have a window of 30 to 90 days to complete your application.

Pitfalls to avoid

Failure of your OPT application can lead to a situation where you can't work in the US, and you may have to leave within a specific timeframe to avoid illegal residency. Common reasons for OPT rejections include the following:

• Violating the 30-day rule

• Mistakes in the I-20 form or school errors

• Failing to meet the requirements stated in the I-765 application

• Exceeding the allowed time for Curricular Practical Training (CPT)

• Your degree failing to fulfill the requirements

• Termination of your SEVIS record or F1 status

Your application may also be denied under the following circumstances:

• Late submission to USCIS

• Clear ineligibility based on OPT requirements

• Already having an OPT approval at the same degree level

• Applying after the expiration of your 60-day grace period

Increase your chances for OPT eligibility.
